By accessing or using Elite Business Coaching services, website, or any applications made available by Elite Business Coaching (together, the "Services"), you agree to be bound by these terms of use ("Terms of Service"). The Services are owned and operated by Elite Business Coaching India ("We", "Us", or "Our"). These Terms of Service affect your legal rights and obligations, so if you do not agree to be bound by all of these Terms of Service, do not access or use the Services.

2. Service Description

Elite Business Coaching provides business coaching and consulting services to individuals and organizations in India. Our services include but are not limited to executive coaching, team development, business growth strategies, startup acceleration, and digital transformation consulting. The specific deliverables and scope of each coaching engagement will be outlined in separate agreements with individual clients.

3. Modifications to Terms

We reserve the right to modify or update these Terms of Service from time to time without prior notice. Changes will be effective immediately upon posting on our website. Your continued use of the Services following the posting of any changes constitutes your acceptance of the revised Terms. It is your responsibility to check these Terms periodically for changes.

4. Eligibility

You must be at least 18 years of age to use our Services. By agreeing to these Terms of Service, you represent and warrant that you are at least 18 years of age. If you are using the Services on behalf of a company, entity, or organization, you represent and warrant that you are an authorized representative of that entity with the authority to bind it to these Terms of Service.

5. Account Registration

Some parts of our Services may require you to create an account. When you create an account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account. We will not be liable for any losses caused by any unauthorized use of your account.

6. Payment Terms

If you choose to purchase our coaching services, you agree to pay all fees associated with such services. All fees are quoted in Indian Rupees unless otherwise specified. Fees for our services are non-refundable except as expressly set forth in a separate coaching agreement. We reserve the right to change our prices at any time. If we change our prices, we will provide notice of the change on the website or by email, at our option.

7. Intellectual Property Rights

The Services and its content, features, and functionality are and will remain the exclusive property of Elite Business Coaching and its licensors. The Services are protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Elite Business Coaching. All materials delivered to you during coaching sessions are for your personal use only and may not be reproduced, distributed, or shared with third parties without our express written permission.

8. User Conduct

By using our Services, you agree not to:

• Use the Services in any way that violates any applicable law or regulation
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
• Interfere with or disrupt the operation of the Services or servers or networks connected to the Services
• Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
• Use the Services to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature
• Use the Services to collect or store personal data about other users without their consent
• Use the Services in a manner that could disable, overburden, damage, or impair the site
• Harass, abuse, or harm another person through use of our Services

9. Confidentiality

We understand that during the course of our coaching relationship, you may share confidential and proprietary information with us. We commit to maintaining the confidentiality of all information shared with us during coaching sessions and will not disclose such information to third parties without your express permission, except as required by law. Similarly, we expect you to maintain the confidentiality of any proprietary methods, tools, or materials we provide as part of our Services.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Elite Business Coaching and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, or other harmful code that may be transmitted to or through the Services
• The outcomes or results of your coaching engagement

11. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. Elite Business Coaching disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will meet your requirements, be uninterrupted, or error-free. The results of coaching are dependent on many factors, including your own effort and implementation, and we make no guarantees regarding specific outcomes or results.

12. Indemnification

You agree to indemnify, defend, and hold harmless Elite Business Coaching, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Services, your violation of any term of these Terms of Service, your violation of any third party right, including without limitation any copyright, property, or privacy right, or any claim that content you provided caused damage to a third party.

13. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms of Service or is harmful to other users of the Services, to us, or to third parties, or for any other reason. Any coaching agreements in place will be governed by the termination provisions contained therein.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and Elite Business Coaching shall be brought exclusively in the courts located within Mumbai, Maharashtra, India.

15. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms of Service will otherwise remain in full force and effect and enforceable.

16. Entire Agreement

These Terms of Service constitute the entire agreement between you and Elite Business Coaching regarding the Services and supersede all prior agreements and understandings, whether written or oral, regarding the Services.
